Cancelation of Removal for Non LPRS
If you have an immigration court date and have been in the US for over 10 years, you might qualify for Cancellation of Removal for Non-LPRs (also known as a 42B application). The requirements to apply are:
- 10 years in the US
- US citizen or Green Card holder parent, spouse, or kids (including stepkids)
- Good moral character
- Not have certain disqualifying criminal convictions
42B applicants qualify for a work permit, so it’s important to start working with an attorney on your case immediately so that you can get your work permit as soon as possible.
Winning a 42B is difficult. It requires extensive documentation, legal analysis, creativity, and luck.
While there’s nothing an attorney can directly do about the luck aspect, the other elements are made stronger by experienced attorneys who care about digging deep into different angles of your situation in order to make the strongest, most creative arguments possible. Many attorneys will do the minimum in order to provide barely competent representation. However, we’ve found that an increase in skilled preparation for telling your story to the judge tends to increase the amount of luck that our clients have.
Start working on your case with an experienced attorney. Doing nothing will change nothing regarding your legal status in the USA. Don’t waste any more time applying for your work permit.
